TERMS, CONDITIONS & DISCLAIMERS
1. PROPERTY SALES
a). Sol Agency Ltd acts only as a referral agency for people who have chosen to contact us directly. We cannot be held responsible for any contracts legal or otherwise between clients and any company or individual, which we are asked to introduce the individual to in good faith.
b). All property details and photos contained on our website are supplied in good faith. Sol Agency Ltd cannot be held responsible if when a potential purchaser actually sees a property, which has been advertised, on our web site it does not match the description, price, location or photographs used in the advert. Additionally Sol Agency Ltd cannot be held responsible for any costs incurred, by potential purchasers who having traveled at their own cost to inspect or purchase a property advertised on our web site find it not to be as advertised. We strongly advise any individual who is considering purchasing property abroad, to take independent legal and financial advice prior to signing any legally binding contracts.
c). All text and pictures including property prices, general and specific information used within this web site is to be treated as a guide to buying property in Spain only. No responsibility can be accepted by Sol Agency Ltd should any of the information be incorrect or untrue.
d). All pictures and text, which are not owned by Sol Agency Ltd, are used in the belief that they are copyright free or used with the owner's permission. Should this not be the case Sol Agency Ltd will remove the material or alternatively if the owner prefers a recognition credit will be attached
2. RENTAL PROPERTY
a). All rental properties on the site are placed by individual owners or small agencies.
b). Every care has been taken in compiling the contents of the Sol Agency website. However, all the information about the properties has been provided by the advertisers and reproduced by us in good faith.
c). Sol Agency Ltd will not be held liable for any inaccuracies, errors, omissions, misunderstandings or claims arising from any advertisement or any arrangement or booking made with an advertiser.
d). When first booking a property we would recommend that you ensure all details are confirmed in writing with the owner/agent and that a receipt for payment of your deposit is obtained. Sol Agency Ltd will endeavor to ensure that all information provided by advertisers is quickly and accurately uploaded to the site, but cannot accept responsibility for inaccuracies or delays in presenting the information.
3. ADVERTISERS
Legal
Sol Agency Ltd. accepts advertisements in good faith and we expect advertisers to provide accurate descriptions of their property.
Advertisements should comply with the relevant UK legislation including the Trade Descriptions Act 1968 (which covers false descriptions) and the Consumer Protection Act 1987 (which covers misleading prices). The advertiser agrees to indemnify Sol Agency Ltd. against all claims costs arising out of any misleading information in the advertisement.
Sol Agency Ltd. reserves the absolute right to refuse to accept any advertisement submitted. A full refund will be given if the advertisement has been paid in advance. We will return any items sent to us by post. Under no circumstances will any compensation be payable by Sol Agency Ltd. for any loss howsoever incurred, including loss of income, the time/cost involved in submitting the advertisement etc.
The advert
Sol Agency Ltd. will take every care when reproducing text, prices, contact details and photographs provided to us by advertisers.
The advertiser must check over the draft web page content carefully before approving it. Sol Agency Ltd. will not be held liable for any loss arising out of any error or omission on our part.
Sol Agency Ltd. reserves the right to determine the design and layout of advertisements and has discretion in making alterations to submitted text or photographs, should we consider it necessary. Sol Agency Ltd. will not be held liable for any loss arising out of such alterations.
Images and materials
Sol Agency Ltd. will take every possible care with all materials and photographs provided for the preparation of advertisements, but cannot be held liable for any loss or damage however caused.
The advertiser is responsible for ensuring that they have the right to reproduce any photographs or digital images supplied to Sol Agency Ltd. and will indemnify Sol Agency Ltd. against all claims costs arising out of any infringement of copyright for such photographs or images.
All digital images produced by Sol Agency Ltd. from photographs supplied by advertisers are the property of Sol Agency Ltd. and shall not be reproduced without our permission.
Sol Agency Ltd. cannot be held liable for any loss or damages howsoever incurred, including consequential losses such as lost income, in connection with advertising on the Sol Agency website.
Link to advertiser's website
Sol Agency Ltd. will, at our sole discretion, include one link per advertisement (where allowed in the relevant subscription package) to the advertiser's own website. This link will be placed in the section containing the owner's details at the end of the advertisement. The advertiser's website must relate only to the rental property or properties advertised on their webpage on the Sol Agency website. We reserve the right to refuse such links, or remove them without notice.
Changing details
Each webpage advertisement relates to a particular property or properties are given a unique reference number and/or name (if requested). Advertisers are not allowed to substitute a different property by changing the text and photographs on an advertisement.
Complaints re advertisement
If Sol Agency Ltd. receives a complaint about a property, for example, in relation to the accuracy of an advertisement, the condition or maintenance of the property, unacceptable booking conditions or procedures, lack of adequate response to complaints etc., we reserve the right to remove the advertisement from our website without notice, if in our opinion the complaint is reasonably justified. We will normally make a refund a pro-rata basis for the remaining unused period of the advertisement. However under no circumstances will any compensation be payable by Sol Agency Ltd. for any loss howsoever incurred, including loss of income, re-advertising costs etc.
Withdrawal of advertisement
The advertiser may choose to withdraw their advertisement from the Sol Agency website at any time by notifying us by letter or e-mail. The advertisement may be re-instated at any time during the period of advertising purchased but the advertising period will not be extended to cover the time when the advertisement was not showing on the Sol Agency website.
Our aims
Sol Agency Ltd. aims to provide advertisers with a cost effective and efficient service. We will do everything possible to create new advertisements for our advertisers as quickly as possible. However, we are unable to guarantee response times as we have no control over our workload.
We will do everything possible to ensure that the Sol Agency website is up and running at all times. However, it's inevitable that there will be times times when the website will breaks in the service for reasons beyond our control. We therefore cannot guarantee 100% availability.
4. INDEMNIFICATION
You agree to indemnify and hold Sol Agency Ltd, its parents, subsidiaries, affiliates, officers and employees, harmless from any claim, demand, or damage, including reasonable legal fees, asserted by any third party due to or arising out of your use of or conduct on the Service.
